How is Property Divided Upon Separation Without a Marriage Certificate?
Pursuant to Article 16 of the Law on Marriage and Family 2014 stipulates:
- Property relations, obligations, and contracts of men and women living together as husband and wife without registering marriage shall be resolved according to the agreement between the parties; in the absence of such an agreement, they shall be resolved according to the provisions of the Civil Code and other relevant legal provisions.
- The resolution of property relations must ensure the legal rights and interests of women and children; housekeeping and other related jobs to maintain a common life shall be considered as income-generating labor.
=> Therefore, when separating without a marriage certificate, the property will be divided according to the agreement of both parties. In the case that it cannot be divided according to the agreement, you can request the court to adjudicate according to the provisions of the Civil Code 2015.
