Fake Author's Signature on a Work: What are the Penalties?

Forgery of an author's signature on a work faces what penalties? Alterations to the electronic rights management information of a work are penalized how? If I discover my book being sold with a fake signature and file a complaint, what penalties will the forger face? If someone accesses a website and changes the rights ownership information of my electronic book, what penalties does that person face?

How are penalties imposed for falsifying the author's signature on a work?

Based on Article 19 of Decree 131/2013/ND-CP, the regulations regarding the falsification of the author's signature on a work are as follows:

  1. A fine ranging from 10,000,000 VND to 15,000,000 VND for the act of falsifying the author's signature on a work.

  2. Remedial measures:

Mandatory destruction of the infringing materials for the act specified in Clause 1 of this Article.

The act of falsifying the author's signature on a work will be fined from 10,000,000 VND to 15,000,000 VND. Additionally, the infringing materials will be mandatorily destroyed.

How are penalties imposed for altering the electronic rights management information of a work?

According to Article 20 of Decree 131/2013/ND-CP, amended by Clause 2, Article 1 of Decree 28/2017/ND-CP, the regulations regarding acts of infringing upon the use of technological measures to protect copyright are as follows:

1. A fine ranging from 3,000,000 VND to 5,000,000 VND for intentionally deleting or altering electronic rights management information attached to the original or copy of a work.

  1. A fine ranging from 5,000,000 VND to 10,000,000 VND for intentionally removing or disabling technical and technological measures implemented by the copyright owner to protect their copyright over their work.

  2. A fine ranging from 10,000,000 VND to 20,000,000 VND for producing, assembling, modifying, distributing, importing, exporting, selling, or renting equipment or systems that disable the technical and technological measures implemented by the copyright owner to protect their copyright over their work.

  3. Remedial measures:

a) Mandatory destruction of the infringing materials for acts specified in Clause 2 of this Article;b) Mandatory re-export of the infringing materials for acts of import specified in Clause 3 of this Article. In cases where re-export cannot be applied, mandatory destruction shall be applied.

Thus, altering the electronic rights management information of an author's book will be fined from 3,000,000 VND to 5,000,000 VND.
