What are the penalties for not naming the singer on the broadcast program?

Pursuant to Article 21 of Decree 131/2013/ND-CP as amended by Clause 2, Article 3 of Decree 28/2017/ND-CP on acts infringing on the right to protect the integrity of the performance image as follows:

1. A fine ranging from VND 2,000,000 to VND 3,000,000 shall be imposed for acts of not naming or incorrectly naming the performer on the audio recording, video recording, or broadcast program.

  1. A fine ranging from VND 3,000,000 to VND 5,000,000 shall be imposed for acts of impersonating the performer to perform the work.

  2. Remedial measures:

a) Compulsory public correction on mass media or mandatory correction of the correct name of the performer for the act prescribed in Clause 1 of this Article;

b) Compulsory removal of copies of audio and video recordings violating electronically, on the network, and digital environment or mandatory destruction of violating exhibits for the acts prescribed in Clause 2 of this Article.

Thus, the act of not naming the singer on the broadcast program will be fined from VND 2,000,000 to VND 3,000,000 and required to make a public correction on the mass media.

What are the penalties for performer distortion behavior?

According to the provisions of Article 22 of Decree 131/2013/ND-CP as amended by Clause 2, Article 3 of Decree 28/2017/ND-CP regarding acts infringing on the right to protect the integrity of the performance image as follows:

  1. A fine ranging from VND 3,000,000 to VND 5,000,000 shall be imposed for acts of arbitrarily modifying, cutting the performance image causing harm to the honor and reputation of the performer.

2. A fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed for acts of distorting the performance image causing harm to the honor and reputation of the performer.

  1. Remedial measures:

a) Compulsory public correction on mass media for acts prescribed in Clause 1 and Clause 2 of this Article;

b) Compulsory removal of copies of the violating performance electronically, on the network, and digital environment or mandatory destruction of violating exhibits for the acts prescribed in Clause 1 and Clause 2 of this Article.

Thus, the act of distorting the singer's performance image causing harm to the honor and reputation will be fined from VND 5,000,000 to VND 10,000,000. It is compulsory to make a public correction on mass media and compulsory public correction on mass media for the violation.
