Household registration in the province but husband has KT3 in Saigon, is marriage registration possible?
Article 17 of the Law on Civil Status 2014 stipulates that the People's Committee at the commune level where one of the parties resides shall carry out marriage registration.
And according to Article 1 of the Law on Residence 2006:
Residence refers to the situation in which a citizen lives at a location within a commune, ward, or commune-level town in the form of permanent or temporary residence.
Thus, in the case where both spouses have household registration in the province, but the husband has KT3 in Ho Chi Minh City, the two of you can proceed with marriage registration in Ho Chi Minh City.
Based on Article 10 of Decree 123/2015/ND-CP, the documents both parties need to prepare are:
- Certificate of singleness for marriage registration issued by the Commune-level People's Committee where each party resides;
- KT3 of the boyfriend in Ho Chi Minh City.
Therefore, if you already have a certificate of singleness and your boyfriend has KT3 in Ho Chi Minh City, you also need to prepare a certificate of singleness for your boyfriend.
