Father Applying for a Criminal Record Certificate for His Child: Required Documents
According to Clause 1, Article 45 of the 2009 Law on Judicial Records, the person requesting the issuance of a judicial record certificate must prepare the following documents:
- A declaration requesting the issuance of a Judicial Record Certificate (using the form issued in conjunction with Circular 13/2011/TT-BTP)
- A copy of the identity card or passport of the person being issued the Judicial Record Certificate;
- A copy of the household registration book or certificate of permanent or temporary residence of the person being issued the Judicial Record Certificate;
Additionally, Clause 3, Article 45 of the 2009 Law on Judicial Records stipulates:
Individuals may authorize others to carry out the procedures for requesting the issuance of a Judicial Record Certificate. The authorization must be made in writing in accordance with the law; in case the person requesting the issuance of a Judicial Record Certificate is the parent, spouse, or child of the person being issued the Judicial Record Certificate, no written authorization is required.
Therefore, if your father requests the issuance of the certificate on your behalf, he needs to prepare the aforementioned documents without needing a written authorization.
