Does the Temporary Residence Card of a Foreign National Expire When the Foreign National Divorces a Vietnamese Citizen?
According to Article 36 of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2014, the cases eligible for a temporary residence card include:
- Foreigners who are members of diplomatic missions, consular posts, representative offices of international organizations under the United Nations, intergovernmental organizations in Vietnam, and spouses, children under 18 years old, and service personnel accompanying them for their tenure are granted temporary residence cards with the symbol NG3.
- Foreigners granted visas with the symbols LV1, LV2, DT, NN1, NN2, DH, PV1, LD, TT are considered for granting temporary residence cards with similar symbols to visa symbols.
Furthermore, Article 38 of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2014 stipulates the duration of the temporary residence card for foreigners as follows:
- The duration of the granted temporary residence card must be at least 30 days shorter than the remaining validity period of the passport.
- Temporary residence cards with the symbols NG3, LV1, LV2, DT, and DH have a validity period not exceeding 5 years.
- Temporary residence cards with the symbols NN1, NN2, TT have a validity period not exceeding 3 years.
- Temporary residence cards with the symbols LD and PV1 have a validity period not exceeding 2 years.
- Expired temporary residence cards can be considered for renewal.
Therefore, the duration of the temporary residence card of foreigners is subject to the above terms regardless of the marital status of the cardholder.
