Does the District People's Committee Have the Authority to Register Adoptions?
Pursuant to Article 9 of the 2010 Law on Adoption, regulations on the authority for registering the adoption of children are as follows:
The People's Committee of a commune, ward, or commune-level town (hereinafter collectively referred to as the commune-level People's Committee) where the person introduced for adoption or the adopter resides shall register the domestic adoption.
The People's Committee of a province or centrally run city (hereinafter collectively referred to as the provincial-level People's Committee) where the person introduced for adoption resides shall decide on the adoption involving foreign elements; The Department of Justice of the province or centrally run city shall register the adoption involving foreign elements.
The representative body of the Socialist Republic of Vietnam abroad shall register the adoption of Vietnamese citizens temporarily residing abroad.
According to this regulation:
The commune-level People's Committee registers domestic adoptions;
The Department of Justice of the province or centrally run city registers adoptions involving foreign elements;
The representative body of the Socialist Republic of Vietnam abroad registers the adoption of Vietnamese citizens temporarily residing abroad.
Thus, the district-level People's Committee does not have the authority to register adoptions.
