Does Going to Work Abroad Lead to the Removal of Permanent Residency?
According to Article 24 of the 2020 Residence Law, which regulates the deletion of permanent residence registration. To be specific:
- A person who falls into one of the following cases shall have their permanent residence registration deleted:
a) Deceased; there is a court decision declaring missing or deceased;
b) Moving abroad to settle;
c) There has been a decision to annul permanent residence registration as provided in Article 35 of this Law;
d) Absent continuously from the place of permanent residence for 12 months or more without registering temporary residence at another place or without declaring temporary absence, except for cases of going abroad but not for settlement or cases of serving imprisonment sentences, undergoing compulsory education measures, being sent to compulsory rehabilitation centers, or being sent to reform schools;

Thus, in the case where your husband goes abroad for labor export, it does not fall under the case of having the permanent residence registration deleted. Therefore, what the commune says is not justified.
