Does a Stem Cell Bank Have Legal Entity Status?
Based on Clause 5, Article 35 of the 2006 Law on Donation, Removal, and Transplantation of Human Tissues, Organs, and Donation of Bodies, the provisions are as follows:
- A tissue bank is a medical facility established by an agency, organization, or individual.
- A tissue bank is authorized to receive, preserve, store, and transport tissues; supply tissues to medical facilities or research, medical training institutions, and engage in international cooperation for tissue exchange.
- A tissue bank has legal person status and is permitted to operate only after obtaining a license from the Ministry of Health.
Thus, according to the above regulations, a tissue bank still has legal person status.
