Document for Authorization to Obtain Criminal Record No. 1
According to Article 3, Article 45 of the 2009 Law on Judicial Records stipulating the authorization for issuing judicial records as follows:
Individuals may authorize others to carry out procedures for requesting the issuance of a Judicial Record Certificate. The authorization must be made in writing in accordance with the provisions of law; in case the requester for the issuance of a Judicial Record Certificate is a father, mother, wife, husband, or child of the person who is granted the Judicial Record Certificate, no written authorization is required.
Thus, when you ask your brother to apply for a judicial record, you need a written authorization.
The complete documentation for authorizing the issuance of a judicial record is as follows:
- A copy of the identity card or passport of the person who is granted the Judicial Record Certificate;
- A copy of the household registration book or certificate of permanent or temporary residence of the person who is granted the Judicial Record Certificate;
- The written authorization.
