Do spouses have an obligation to live together?
Dear Editorial Board,
Please help me with the following question: Do spouses have an obligation to live together? I look forward to receiving your response soon. Thank you!
Response:
Regarding this issue, Article 19 of the 2014 Law on Marriage and Family provides as follows:
- Spouses have the obligation to love, be faithful, respect, care for, and help each other; share and perform household duties together.
- Spouses have an obligation to live together, except in cases where the spouses agree otherwise or due to job requirements, work, studies, participation in political, economic, cultural, social activities, and other legitimate reasons.
=> Thus, according to this regulation, spouses have an obligation to live together, except in certain cases due to legitimate reasons.
Are family members required to live in the same house?
Hello, if a grandmother and her grandchild do not live in the same house, are they considered family members? Please help me with this question.
Response:
Clause 16 of Article 3 of the 2014 Law on Marriage and Family defines family members as follows:
Family members include spouses; biological parents, adoptive parents, stepfathers, stepmothers, in-laws; biological children, adopted children, stepchildren of either spouse, daughters-in-law, sons-in-law; siblings from the same parents, half-siblings, half-brothers by the same father or mother, brothers-in-law, sisters-in-law; grandparents; grandchildren; aunts, uncles, nephews, nieces.
Thus, those listed above are identified as family members. Determining who is a family member depends on blood relations, not the place of residence.
Therefore, even if a grandmother and her grandchild do not live in the same house, they are still identified as family members.
Is it mandatory for the wife to live with the husband's family after marriage?
May I ask, is it legally required for me to live with my husband's family after our marriage?
Response:
Article 20 of the 2014 Law on Marriage and Family provides for the choice of residence of spouses as follows:
The choice of the residence of spouses is agreed upon by the spouses and is not bound by customs, practices, or administrative boundaries.
Based on the above regulation, the law does not require that after marriage, the couple must live with the husband's family. Thus, the couple can agree on their place of residence.
Sincerely!
