Hello, I have this problem that needs to be answered. On August 5, I will fly from Hanoi to Saigon to attend my niece's wedding. Partly because it's a long distance and it's been a long time since our family last saw each other. Now that I have opportunity to attend the wedding, I stayed with my niece's house for 10 days. So let me ask, do I need to declare my stay during the 10 days I stay in Vietnam?

In Clause 6, Article 2 of the Law on Residence 2020, definitions are as follows:
6. “stay” means a citizen’s state of living at a location save their permanent or temporary residence for less than 30 days.
According to Article 30 of the Law on Residence 2020, stay notification is as follows:
1. When someone comes to stay with a household or at a healthcare establishment, tourist accommodation establishment or other types of lodging, a member of the household or the representative of the establishment shall notify the person’s stay with the registration authority; in case a person comes to stay in the place of residence of an absent individual or household, the person shall notify their stay with the registration authority.
2. Stay notification may be carried out in person, by phone or by electronic means or other means as per regulations from the Minister of Public Security.
3. A stay notification includes full name and identity card number or passport number of the staying person; stay reason; stay duration; and address of the hosting place.
4. Stay notification must be done before 11:00PM of the starting day of the stay period; if a person comes to stay after 11:00PM, their stay shall be notified before 08:00AM of the following day; biological siblings, children, spouse, parents and grandparents coming to stay multiple times only need to notify their stay once.
5. Stay notifications shall be recorded into stay receipt books.
Thus, according to the above regulations in Vietnam, if you stay at your relative's house for 10 days, you need to declare your stay. You must declare before 11:00 PM of the starting day of the stay period, that is, on August 5, your niece's family must declare your stay on August 4.

How much is fine for not declaring stay in Vietnam?
Pursuant to Clause 1, Article 9 of Decree 144/2021/ND-CP regulating violations against regulations on residence management and registration as follows:
1. A fine ranging from 500.000 VND to 1.000.000 VND shall be imposed for any of the following violations:
a) Failure to comply with regulations on registration of permanent residence and temporary residence, cancellation of permanent residence and temporary residence, household division or revision of residence in of in Residence Database;
b) Failure to comply with regulations on notification of residence and temporary absence;
c) Failure to present the family register, temporary residence register, residence certification, other residence documents at the request of a competent authority.
In Clause 2, Article 4, Decree 144/2021/ND-CP stipulates maximum fines, organizations incurring administrative penalties:
2. The fines specified in Chapter II of this Decree are imposed upon administrative violations committed by individuals. The fine imposed upon an organization for the same violation shall be twice the fine imposed upon an individual.
Therefore, if you come to stay at your niece's house for 10 days without declaring your stay, you will be fined from 500,000 VND to 1,000,000 VND.
