Definition of the Civil Code
1. Definition of the Civil Code?
Currently, Vietnamese law does not have a specific definition of the Civil Code. However, Article 1 of the Civil Code 2015 sets forth the scope of regulation of the Civil Code as follows:
This Code regulates the legal status, legal standards on the behavior of individuals and legal entities; the rights and obligations concerning personal identity and property of individuals and legal entities in relationships established based on equality, free will, independence of property, and personal responsibility (hereinafter collectively referred to as civil relations).
You may consider this as the definition of the Civil Code to apply.
2. Application of the Civil Code
- This Code is the general law governing civil relations.
- Other laws relating to civil relations in specific fields must not contravene the fundamental principles of civil law stipulated in Article 3 of this Code.
- In cases where other relevant laws do not provide regulations or do provide regulations but violate Clause 2 of this Article, the provisions of this Code shall apply.
- In cases where there is a discrepancy between the provisions of this Code and international treaties to which the Socialist Republic of Vietnam is a member concerning the same issue, the provisions of the international treaty shall apply.
