Date of Birth on National Identity Card and Birth Certificate Do Not Match: Which One Should Be Recorded in the Party Member's File?
Based on the provisions in Clause 6, Article 4 of the Civil Status Law 2014:
The birth certificate is a document issued by a competent state agency to an individual upon birth registration; the content of the birth certificate includes basic information about the individual as stipulated in Clause 1, Article 14 of this Law.
Additionally, Article 6 of Decree 123/2015/ND-CP stipulates the legal value of the birth certificate as follows:
- The birth certificate is the original civil status document of an individual.
- All dossiers and documents of an individual containing information about surname, middle name, given name; date, month, year of birth; gender; ethnicity; nationality; place of origin; and the relationship of father, mother, child must be consistent with that individual's birth certificate.
- In cases where the content in an individual's dossiers and documents differ from the content in that individual's birth certificate, the head of the managing agency or organization responsible for dossier or document issuance is obligated to adjust the dossiers and documents to match the content in the birth certificate.
According to this regulation, the birth certificate is identified as the original civil status document, hence the information on the ID card and other documents must be consistent with the information on the birth certificate.
Therefore, in the case where the date of birth information on the birth certificate and the ID card do not match, when filling out the party membership application, you must write according to the birth certificate, and at the same time, renew the ID card according to the correct information on the birth certificate.
