Concept of Personal Rights
According to the provisions in Clause 1, Article 25 of the Civil Code 2015, personal rights are as follows:
Personal rights are civil rights closely attached to each individual, non-transferable to others, except in cases where other related laws provide otherwise.
Additionally, the establishment and execution of civil relations related to the personal rights of minors, persons with incapacitated civil acts, persons with difficulties in cognition or behavior control must have the consent of their legal representative in accordance with the provisions of civil law, other related laws, or by decision of the Court.
Furthermore, in the establishment and execution of civil relations related to the personal rights of persons declared missing or deceased, it must be consented by the spouse or adult child of such persons; in cases where these persons are not available, consent must be obtained from the parents of the person declared missing or deceased, except where civil law and other related laws provide otherwise.
