Change to Chip-Based Citizenship Identity Card: Is It Necessary to Amend the Land Use Rights Certificate?
According to Clause 14, Article 6 of Circular 33/2017/TT-BTNMT, the regulations on cases of confirming changes in the issued Certificate when registering changes in land use rights, assets attached to the land are as follows:
Land users, owners of assets attached to the land are allowed to change their names; confirm changes in information regarding legal persons, identity card numbers, citizen identification card numbers, address on the issued Certificate upon the request of the land users, owners of assets attached to the land; confirm changes in information regarding legal persons, identity card numbers, citizen identification card numbers, address on the issued Certificate simultaneously with the procedures for registering changes in land use rights, assets attached to the land.
According to this regulation, land users, owners of assets attached to the land can request confirmation of changes in information regarding identity card numbers, citizen identification card numbers on the issued Certificate if desired.
Thus, confirming the change from an identity card number to a chip-based citizen identification card number on the Certificate is not mandatory. If you do not have the need, you do not need to amend the information regarding the chip-based citizen identification card number on the land use right certificate.
However, the amendment and confirmation of this information can only be carried out simultaneously with the procedures for registering changes in land use rights, assets attached to the land. The change of the citizen identification card number does not fall under the cases of registering changes (Clause 4, Article 95 of the 2013 Land Law). Therefore, the confirmation of this change of information cannot be carried out independently.
