Can You Register for Marriage on Your Own if Your Parents Don't Consent?
According to Article 8 of the Law on Marriage and Family 2014 that regulates conditions for marriage, as follows:
- A man and a woman getting married must adhere to the following conditions:
- The man is at least 20 years old, and the woman is at least 18 years old;
- The marriage is voluntarily decided by the man and the woman;
- Neither party loses civil act capacity;
- The marriage does not fall into one of the prohibited cases as specified in points a, b, c, and d, clause 2, Article 5 of this Law.
Note: The State does not recognize marriage between people of the same sex.
Thus, if the families of both parties do not agree to their marriage, they can still register for marriage if they meet the above stipulations. Family approval is not a mandatory condition.
Additionally, point b, clause 2, Article 5 of this Law states that child marriage, forced marriage, deceitful marriage, and marriage obstruction are prohibited acts in the protection policies of marriage and family.
And at point e, clause 1, Article 59 of Decree 82/2020/ND-CP stipulates the acts of violations concerning marriage, divorce and violations of marital policies under the monogamous marriage regime, as follows:
- A fine of between 3,000,000 VND and 5,000,000 VND shall be imposed for any of the following acts: Obstructing marriage, requiring property in marriage, or obstructing divorce.
- The violator shall be required to remit the illegal profits earned from the acts prescribed in points d and e, clause 2 of this Article.
Thus, parents obstructing their child's marriage can be fined up to 5 million VND according to the latest regulations.
