Can the Wife Be the Household Head?
At Article 10 of the Law on Residency 2020, it is stipulated:
- The head of household is a person with full civil act capacity unanimously nominated by the household members; in cases where the household does not have a person with full civil act capacity, the head of household is the person unanimously nominated by the household members; in cases where the household members cannot reach a unanimous decision, the head of household is a household member decided by the court.
In cases where the household consists of only one person, that person is the head of household.
- The head of household has the rights and obligations to implement, facilitate, and guide household members to comply with regulations on registration and residency management as well as other contents according to this Law; notify the residence registration authority when a household member falls under the cases stipulated in Clause 1 Article 24 and Clause 1 Article 29 of this Law.
- Household members have the rights and obligations to unanimously nominate the head of household; fully comply with the regulations on registration and residency management.
=> Thus, according to the above regulations, the law does not require the head of household to be the husband or wife. Therefore, the wife still has the right to be the head of household.
