Can parents prevent their children from choosing professions and occupations for training because of gender in Vietnam? How much is fine for parents who prevent their children from choosing professions and occupations for training because of gender in Vietnam? What are violations of the law on gender equality in the family in Vietnam? 

Hello, I have a problem that needs to be answered. I'm female and this year I'm in grade 12. My university education plan is that I will study construction, but my parents forbid it because that field is only for boys. Can I ask if my father or mother can stop me? If parents are not allowed to prevent, what is penalty for them?

Article 14 of the 2006 Gender Equality Law stipulates gender equality in the field of education and training as follows:

1. Man and woman are equal in terms of age for schooling, training and fostering courses.

2. Man and woman are equal in choosing professions and occupations for learning and training.

3. Man and woman are equal in accessing and benefiting from the policies on education, training, fostering of professional knowledge and skills.

4. Female officials, public servants bringing along their children less than 36 months of age when participating in the training and fostering activities shall be given assistance and support as provided by the Government.

5. Measures to promote gender equality in the field of education and training include:

a) To provide for the proportion of man and woman participating in the study and training;

b) To assist female workers in rural areas in vocational training under the law.

Thus, according to the above regulations in Vietnam, men and women are equal in choosing professions and occupations for learning and training. There are no professions or professions specifically for any gender.

If your parents forbid you from choosing a construction major to study at university because that major is only for boys, your parents are breaking the law. No one has right to prevent others from choosing majors or training because of gender in Vietnam.

How much is fine for parents who prevent their children from choosing professions and occupations for training because of gender in Vietnam?

According to Article 9 of Decree 125/2021/ND-CP regulating administrative violations in gender equality related to education and training as follows:

1. A warning shall be imposed for campaigning, inciting or not allowing others to go to school, study and improve knowledge due to gender reasons.

2. A fine from 500,000 VND to 1,000,000 VND shall be imposed for forcing or hindering others from choosing subjects, majors, or professions of learning or training due to gender reasons.

3. Fine from 2,000,000 VND to 3,000,000 VND for campaigning or forcing others to drop out of school due to gender reasons.

4. Fine from 5,000,000 VND to 10,000,000 VND for one of the following acts:

a) Organizing mobilization and forcing of many people to drop out of school due to gender reasons;

b) Refusing admission to qualified people in training and fostering courses due to gender reasons or due to pregnancy, childbirth, or raising children.

5. Fine from 10,000,000 VND to 15,000,000 VND for the act of regulating different training and enrollment ages for men and women.

6. Fine from 15,000,000 VND to 20,000,000 VND for one of the acts of organizing vocational education, compiling and disseminating textbooks, curriculum, and teaching programs with gender prejudice content.

7. Remedial measures:

a) Force the restoration of the violated person's legal rights for the acts specified in Clauses 1, 2, 3 and 4 of this Article;

b) Force to amend or abolish regulations on training age and enrollment age that discriminate against gender for the acts specified in Clause 5 of this Article;

c) Forced to amend, replace or correct textbooks, textbooks, and teaching programs that contain gender bias content. If not amended, replaced or corrected, documents containing gender bias content must be destroyed for the acts specified in Clause 6 of this Article;

d) Forced to return illegal profits obtained from committing the acts specified in Clause 6 of this Article.

Therefore, if your father or mother forbids you from studying construction because that field is only for boys, you will be fined from 500,000 VND to 1,000,000 VND. In addition, force your parents to let you freely choose your major or training in Vietnam.

What are violations of the law on gender equality in the family in Vietnam? 

Pursuant to Article 41 of the 2006 Gender Equality Law, violations of the law on gender equality in the family are as follows:

1. Impeding members in the family who have enough qualifications under the law from participating in the determination of assets of common proprietary of a family for gender reasons.

2. Not allowing or impeding members in the family from contributing their opinion to the use of common assets of the family, from conducting income earning activities or satisfying other needs of the family for gender preconception reasons.

3. Unequally treating family members for gender reasons.

4. Constraining or forcing members in the family to leave school for gender reasons.

5. Imposing the realization of family work and the conduct of contraceptive measures as responsibilities of members of certain gender.

Above are prohibited behaviors related to gender in the family in Vietnam.
