Can an Uncle in Difficult Circumstances Adopt His Nephew/Niece as a Child?
Section 1, Section 3 Article 14 of the 2010 Law on Adoption stipulates the conditions for adopters as follows:
- The adopter must meet the following conditions:
a) Have full civil act capacity;
b) Be at least 20 years older than the adoptee;
c) Have health, economic status, and housing conditions that ensure the care, nurture, and education of the adoptee;
d) Have good moral character.

3. In cases where a stepfather adopts the wife's biological child, a stepmother adopts the husband's biological child, or an aunt, uncle, or blood relative adopts a niece or nephew, the provisions at points b and c of clause 1 of this Article are not applicable.
According to the above regulations and the provided information, in the case of an uncle (or aunt) with difficult circumstances, he/she can still adopt his/her biological nephew/niece if he/she has full civil act capacity and good moral character.
