Can an individual apply for Criminal Record Certificate No. 2 at their temporary residence?

Section 2, Article 46 of the 2009 Law on Judicial Records stipulates the procedure for requesting the issuance of Judicial Record Certificate No. 2 for individuals as follows:

The procedure for issuing Judicial Record Certificate No. 2 for individuals is carried out in accordance with Section 1 and Section 2 of Article 45 of this Law; in the case of an individual requesting the issuance of Judicial Record Certificate No. 2, a proxy is not allowed to complete the procedure for the issuance of the Judicial Record Certificate.

Referring to Sections 1 and 2 of Article 45 of the 2009 Law on Judicial Records, the specific procedures are as follows:

- The individual requesting the issuance of the Judicial Record Certificate must submit a declaration requesting the issuance of the Judicial Record Certificate and attach the following documents:

A copy of the identity card or passport of the person to be issued the Judicial Record Certificate.

- The individual shall submit the declaration requesting the issuance of the Judicial Record Certificate and the accompanying documents to the following agencies:

+ Vietnamese citizens shall submit to the Department of Justice where they are permanently residing; in case there is no permanent residence, they shall submit to the Department of Justice where they temporarily reside; in case of residing abroad, they shall submit to the Department of Justice where they resided before departure;

+ Foreigners residing in Vietnam shall submit to the Department of Justice where they are residing; in case they have left Vietnam, they shall submit to the National Center for Judicial Records.

According to the above regulations, you must submit your application for Judicial Record Certificate No. 2 to the Department of Justice where you are permanently residing. In case you do not have a permanent residence, you are allowed to submit it to the Department of Justice where you are temporarily residing.
