Can a Notary Public Candidate Postpone Participation in Military Service?
Based on Clause 1, Article 5 of Circular 148/2018/TT-BQP, the following categories of citizens are eligible for deferment from conscription:
- Those who do not meet the health requirements for active military service as concluded by the Health Examination Council.
- The sole breadwinner directly supporting a family member who is unable to work or is below working age; or belongs to a family that has suffered significant human and property losses due to accidents, natural disasters, or dangerous epidemics, confirmed by the commune-level People's Committee.
- A child of a war invalid, or a person exposed to Agent Orange with a labor capacity reduction from 61% to 80%.
- Having a sibling who is a non-commissioned officer or soldier serving in active duty; or a non-commissioned officer or soldier fulfilling the obligation to serve in the People's Police.
- Those who are migrants or resettled within the first three years to particularly difficult communes according to the socioeconomic development project of the State, decided by the provincial People's Committee or higher authority.
- Officials and public employees, youth volunteers mobilized to work in regions with particularly difficult socioeconomic conditions as prescribed by law.
- Those currently studying in primary educational institutions; pursuing a formal undergraduate education in higher education institutions, or formal collegiate education in vocational education institutions for the duration of one training course at the respective educational level.
=> Therefore, according to the aforementioned regulations, individuals currently studying notary public courses are not eligible for deferment from conscription to perform military service.
