Can a Father-in-Law Marry His Daughter-in-Law?
Based on Point d, Clause 2, Article 5 of the Law on Marriage and Family 2014, which stipulates the prohibitive cases for marriage:
d) Marriage or cohabitation as husband and wife between people of the direct bloodline; between people who have blood relations within three generations; between adoptive parents and adopted children; between people who were once adoptive parents and adopted children, father-in-law and daughter-in-law, mother-in-law and son-in-law, stepfather and wife’s biological child, stepmother and husband's biological child;
Thus, according to the above regulation, a father-in-law and daughter-in-law cannot marry each other.
Who Has the Right to Request Annulment of an Unlawful Marriage?
Based on Article 10 of this Law, which stipulates who has the right to request the annulment of an unlawful marriage as follows:
A person who is coerced into marriage, deceived into marriage, as stipulated by the law on civil procedure, has the right to personally request or propose an individual or organization specified in Clause 2 of this Article request the Court to annul the unlawful marriage due to violations at Point b, Clause 1, Article 8 of this Law.
The following individuals, agencies, and organizations, as stipulated by the law on civil procedure, have the right to request the Court to annul an unlawful marriage due to violations at Points a, c, and d, Clause 1, Article 8 of this Law:
a) The spouse of a person who is already married but marries another; parents, children, guardians, or other legal representatives of a person in an unlawful marriage;
b) State management agencies on families;
c) State management agencies on children;
d) Women’s Union.
- Other individuals, agencies, and organizations, upon discovering an unlawful marriage, have the right to propose the agencies and organizations specified in Points b, c, and d, Clause 2 of this Article request the Court to annul the unlawful marriage.
