Can a Child be Registered for Birth at the Maternal Grandparents' Residence If the Parents are Registered at the Paternal Grandparents' Residence?
According to Article 13 of the Law on Civil Status 2014, the authority to register births is stipulated as follows:
The People’s Committee of the commune where either the father or mother resides shall register the birth.
According to Article 11 of the Law on Residence 2020, the residence of citizens is defined as follows:
The place of residence of a citizen includes the place of permanent residence and the place of temporary residence.
In cases where neither the permanent residence nor the temporary residence can be determined, the place of residence of the citizen shall be the current place of residence as defined in Clause 1, Article 19 of this Law.
Thus, in the above case, you and your husband are permanently residing at the paternal grandparents' house. If you or your husband or both of you are temporarily registered at the maternal grandparents' house, your child can have their birth registered at the maternal grandparents' house.
Can a Child be Registered for Permanent Residence at the Maternal Grandparents' House?
Point c, Clause 2, Article 20 of the Law on Residence 2020 stipulates the conditions for permanent residence registration as follows:
- Citizens may register for permanent residence at a legal residence not owned by them if they are agreed to by the household head and the legal owner of the residence in the following cases:
a) The wife lives with the husband; the husband lives with the wife; the child lives with the father or mother; the father or mother lives with the child;
b) The elderly live with their siblings, nephews/nieces; severely handicapped people, severely disabled people, people unable to work, people with mental illnesses or other diseases that impair cognition or behavior live with their paternal grandparents, maternal grandparents, siblings, uncles/aunts, guardians;
c) Minors receive consent from their father, mother or guardian or if they no longer have a father or mother, they live with paternal or maternal great-grandparents, paternal grandparents, maternal grandparents, siblings, uncles/aunts, guardians.
Thus, in your case, your child can be registered for permanent residence (household registration) at the maternal grandparents' house. However, to register for permanent residence at the maternal grandparents' house, you must meet the following conditions:
Firstly, you and your husband must both agree on registering the child at the maternal grandparents' house.
Secondly, the maternal grandparents must agree to allow your child to be registered for permanent residence.
