Can a 40-year-old be a surrogate mother?
Section 3, Article 95 of the Law on Marriage and Family 2014 stipulates:
The person commissioned for surrogate pregnancy must meet the following conditions:
a) Is a relative of either the wife or the husband commissioning the surrogate pregnancy;b) Has given birth before and is allowed to be a surrogate only once;c) Is of appropriate age and has a certification from a competent medical organization regarding the capacity to be a surrogate;d) In cases where the surrogate woman is married, there must be written consent from her husband;e) Has been provided with medical, legal, and psychological counseling.
The regulation only requires the person commissioned for surrogate pregnancy to be of appropriate age and to have a certification from a competent medical organization regarding the capacity to be a surrogate. There is no specific age mentioned; therefore, if a competent medical organization certifies, a 40-year-old can still act as a surrogate.
