Birth certificate without father's name, can a citizen identity card be issued? What is required to add the father's name to the birth certificate?
My daughter is now 14 years old. After she was born for a year, my wife and I registered our marriage. Therefore, my daughter's birth certificate only records information about the mother and does not have information about the father. I would like to know if my daughter can be issued a Citizen Identity Card if her birth certificate does not have the father's name? And what is required to add the father's name to the birth certificate? Pursuant to Article 18 of the 2014 Law on Citizen Identification, the contents displayed on the Citizen Identification Card are as follows:
The Citizen Identification Card includes the following information:
a) The front side of the card has the National Emblem of the Socialist Republic of Vietnam; the phrase "Socialist Republic of Vietnam, Independence - Freedom - Happiness"; the phrase "Citizen Identification"; photo, Card number, full name in birth certificate, date of birth, gender, nationality, hometown, permanent residence; expiration date;
b) The back side of the card has an encoding storage part for information; fingerprint, identification marks of the person issued with the card; date of issuance; full name, title, signature of the issuing authority, and the seal with the National Emblem of the issuing authority.
The Minister of Public Security specifies in detail the format, language, shape, size, material of the Citizen Identification Card.
Currently, there is no legal provision requiring that the procedures for issuing the Citizen Identification Card must have complete information about the father and mother. In practice, there are many cases such as abandoned children whose birth certificates do not record the names of both the father and mother, or due to family circumstances, the birth certificate only records the mother's name. In these cases, the lack of father’s and mother’s information does not affect the issuance process of the Citizen Identification Card. Your child can still obtain a Citizen Identification Card even if the father's name is missing on the birth certificate.
What is needed to add the father's name to the birth certificate?
Pursuant to Clause 2, Article 16 of Circular 04/2020/TT-BTP regulating the registration of acknowledgement of father, mother, and child, and the addition of civil status in certain special cases as follows:
- In the case where the child is born by the wife before the marriage registration, has been registered with a birth certificate but does not have the father's information, and the couple now have a written acknowledgement that it is their common child, they do not need to carry out the procedures for acknowledging father and child but proceed with the procedures for adding civil status to record the father's information in the Birth Registration Book and the child's Birth Certificate.
You only need to make a written acknowledgement of the common child, not needing to carry out the procedures for acknowledging father and child but only need to carry out the procedures for adding civil status in order to record the father's information in the birth registration book and the child's birth certificate. The procedure for adding civil status in this case is simpler and saves a lot of time and costs compared to the procedure for acknowledging father and child. To add civil status, you need to go to the commune-level People's Committee (commune, ward, commune-level town) to proceed with the procedures.
