Birth Certificate with Incorrect Mother's Name from Three Years Ago: Valid for Birth Registration?
When issuing a birth certificate, the registry officer will check and compare the information on the documents and records used for the birth registration procedure. In the case of inconsistent information, there is a high likelihood that they will require corrections and refuse the registration. Therefore, in this case, you should re-issue the birth certificate before registering the birth for the child.
Point a, Clause 3, Article 2 of Circular 17/2012/TT-BYT stipulates the procedure for re-issuing a Birth Certificate, specifically:
In the case a Birth Certificate has been issued and an error is discovered in the recording of the Birth Certificate: the child's parent or relative must submit an Application for Re-Issuance of Birth Certificate according to the form stipulated in Appendix 03 issued together with this Circular, along with documents proving the erroneous content to the healthcare facility where the initial Birth Certificate was issued. Within 02 working days from the date of receiving the valid documents, the healthcare facility is responsible for revoking the erroneous Birth Certificate for destruction, and the application and proof documents are filed along with the old record at the healthcare facility. The re-issued Birth Certificate must clearly state the number and volume number of the old Birth Certificate and be stamped "Re-issued". In cases requiring verification, the verification period should not exceed 03 working days.
Documents proving the erroneous content: in cases of errors related to the mother's or guardian's name, year of birth, place of permanent residence registration, ID number, ethnicity, a photocopy of the ID card should be attached (bring the original for comparison); in cases of errors related to the place of temporary residence registration, a verification from the local police on the temporary residence registration should be included.
This regulation does not limit the time period within which the Birth Certificate can be re-issued, so even if it has been 3 years, you can still apply for re-issuance.
