Authority in Marriage Registration Involving Foreign Elements
Authority for registering marriages involving foreign elements belongs to the agency specified in Clause 2, Section I, Part II, Decision 1872/QD-BTP of 2020. To be specific:
Competent Authorities:
People’s Committee at the district level where the Vietnamese citizen resides shall carry out marriage registration between a Vietnamese citizen and a foreigner; between a Vietnamese citizen residing domestically and a Vietnamese citizen residing overseas; between overseas Vietnamese citizens; between a Vietnamese citizen who also holds foreign nationality with a Vietnamese citizen or a foreigner.
- In cases where a foreigner residing in Vietnam requests marriage registration, the People’s Committee at the district level where one of the parties resides shall carry out the marriage registration.
Agency for administrative procedures:
The Justice Division at the district level receives documents and advises the Chairman of the People’s Committee at the district level to review and decide.
