Authority for Re-registering Marriages Involving Foreign Elements Belongs to Which Agency?

The authority to re-register marriages involving foreign elements is stipulated in Part II of Decision 1872/QD-BTP of 2020. To be specific:

Competent authorities for decision-making:

- The district-level People's Committee where the marriage was previously registered.

- In cases where the previous marriage registration was done at the commune-level People's Committee, the re-registration is carried out by the superior district-level People's Committee.

- In cases where the previous marriage registration was done at the provincial-level People's Committee or the Department of Justice, the re-registration is carried out by the district-level People's Committee where the requester resides; if the requester does not reside in Vietnam, it is carried out by the district-level People's Committee where the current headquarters of the Department of Justice is located.

Authority responsible for administrative procedures:

The District Justice Office receives the dossier and advises the Chairman of the district-level People's Committee for consideration and decision.
