Adding the Wife’s Name to the Land Use Rights Certificate – Is It Possible?
Point d Clause 1 Article 76 of Decree 43/2014/ND-CP stipulates the reissuance of the Certificate of Land Use Rights, Certificate of Home Ownership, and Certificate of Construction Ownership in the following cases:
In the case where the land use rights and ownership of assets attached to the land are common assets of both spouses, and the issued certificate only records the name of either the wife or husband, there is now a request to reissue the certificate to record both names of the wife and husband.
According to Clause 1 Article 33 of the Law on Marriage and Family 2014, it is stipulated:
The land use rights acquired by either spouse after the marriage are the common assets of both spouses, except in cases where either the wife or husband inherits it individually, it is gifted individually, or acquired through transactions with personal assets.
Therefore, the land use rights being the common assets of both spouses are currently only in your husband's name, but if requested, it can be reissued to include the names of both spouses.
