Which organizations and individuals are allowed to register pesticides in Vietnam?
Pursuant to Article 50 of the Law on Plant Protection and Quarantine 2013 stipulates that organization and individual entitled to register their pesticides in Vietnam:
Organization and individual entitled to register their pesticides in Vietnam
1. Domestic organization, individual getting involved in the manufacturing of active ingredients, technical materials or finished pesticide products from technical materials.
2. Foreign organization and individual getting involved in the manufacturing of active ingredients, technical materials or finished pesticide products from technical materials, who have registered their legal representative offices, agencies or branches in Vietnam.
3. Any domestic or foreign organization and individual eligible for the manufacturing and trading of pesticides as stipulated in Article 61 and 63 of this Law, who are authorized by another organization and individual regulated in Clause 1 and 2 of this Article.
According to this Article, organizations and individuals can register pesticides in Vietnam, including:
(1) Domestic organizations and individuals that produce active ingredients, technical drugs or produce finished drugs from technical drugs.
(2) Foreign organizations and individuals that produce active ingredients, technical drugs or produce finished drugs from technical drugs have representative offices, companies, or branches of companies dealing in pesticides that are being approved. License to operate in Vietnam.
(3) Domestic and foreign organizations and individuals that are qualified to produce and trade pesticides are authorized by the organizations and individuals in sections (1), (2).
For plant protection drug manufacturing facilities in Vietnam
- Conditions on material and technical facilities are specified as follows:
+ The drug manufacturing facility has a location, factory, and drug warehouse that ensures area and safe distance for people, pets, and the environment in accordance with regulations and in accordance with production scale;
+ Machinery, equipment and technological processes suitable for the type of pesticide being produced;
+ Have a waste treatment system that ensures waste treatment meets national environmental standards and technical regulations;
+ Have enough equipment to check the quality of the pesticides they produce.
+ In case there is not enough equipment, there must be a quality inspection contract with an organization designated to inspect the quality of pesticides for each batch of products shipped.
- Human resource conditions are specified as follows:
+ People who directly manage and direct production of a plant protection drug manufacturing facility have a university degree or higher in chemistry, plant protection, or biology;
+ Workers directly producing pesticides must be trained and fostered in appropriate expertise.
For conditions for trading plant protection drugs in Vietnam
- Organizations and individuals trading in pesticides must ensure the following conditions:
+ Have a legal location, ensuring area and safe distance for people, pets and the environment in accordance with regulations;
+ Have a prescribed drug warehouse and appropriate equipment to preserve and handle pesticides when an incident occurs;
+ Owners of drug trading establishments and people directly selling pesticides must have intermediate or higher degrees in plant protection, horticulture, biology, chemistry or have a certificate of professional training. about plant protection drugs.

1. The list of approved plant protection chemicals in Vietnam (Appendix I enclosed herewith) includes:
a) Chemicals used in farming:
- Pesticides: 712 active ingredients and 1725 trade names.
- Fungicides: 683 active ingredients and 1561 trade names.
- Herbicides: 260 active ingredients and 791 trade names.
- Rodenticides: 8 active ingredients and 43 trade names.
- Plant-growth regulators: 60 active ingredients and 178 trade names.
- Pheromones: 8 active ingredients and 8 trade names.
- Snailicides: 31 active ingredients and 152 trade names.
- Supporting Chemicals: 5 active ingredients and 6 trade names.
b) Termiticides: 16 active ingredients and 23 trade names.
c) Forest product preservatives: 7 active ingredients and 8 trade names.
d) Warehouse disinfectants: 3 active ingredients and 9 trade names.
dd) Golf course chemicals:
- Fungicides: 2 active ingredients and 2 trade names.
- Herbicides: 1 active ingredient and 1 trade name.
- Plant-growth regulators: 1 active ingredient and 1 trade name.
e) Seed treatment chemicals:
- Pesticides: 10 active ingredients and 16 trade names.
- Fungicides: 12 active ingredients and 12 trade names.
g) Chemicals for postharvest treatment of agricultural products

(1) Drugs used in agriculture:
- Pesticides: 712 active ingredients with 1725 trade names.
- Fungicides: 683 active ingredients with 1561 trade names.
- Herbicides: 260 active ingredients with 791 trade names.
- Rat repellent: 08 active ingredients with 43 trade names.
- Growth regulators: 60 active ingredients with 178 trade names.
- Insect attractants: 08 active ingredients with 08 trade names.
- Snail insecticide: 31 active ingredients with 152 trade names.
- Supporting agent (spreading agent): 05 active ingredients with 06 trade names.
(2) Termite insecticide: 16 active ingredients with 23 trade names.
(3) Forest product preservatives: 07 active ingredients with 08 trade names.
(4) Warehouse disinfectant: 03 active ingredients with 09 trade names.
(5) Medicines used on golf courses:
- Fungicides: 02 active ingredients with 02 trade names.
- Herbicide: 01 active ingredient with 01 trade name.
- Growth regulators: 01 active ingredient with 01 trade name.
(6) Seed treatment:
+ Pesticides: 10 active ingredients with 16 trade names.
(7) Post-harvest agricultural product preservatives

In what cases are pesticides removed from the List of pesticides permitted for use in Vietnam?
Pursuant to Clause 2, Article 49 of the Law on Plant Protection and Quarantine 2013 stipulates that pesticides that are eliminated from the Nomenclature of permitted pesticides in Vietnam shall be specified as follows:
a) Any pesticide has been scientifically proven that it can cause harmful impact on human health, domestic animals, ecosystem and environment;
b) Any pesticide that is of low efficacy in killing harmful organisms;
c) Any pesticide that has been eliminated from the Nomenclature of permitted pesticides in Vietnam at any organization’s discretion.
