What are cases in which officers of the Vietnam People's Army cease active service?
Pursuant to Article 35 of the Law on Officers of the Vietnam People's Army 1999 (amended by Clause 11, Article 1 of the Law on Amendments to the Law on Officers of the Vietnam People's Army 2008), the cases for ceasing active duty are as follows:
Article 35. Officers cease active duty
- Officers cease active duty in the following cases:
a. Meeting the conditions for retirement;
b. Reaching the age limit for active duty stipulated in Article 13 of this Law;
c. Due to organizational changes or restructuring, there is no longer a need for professional military officers and defense officials;
d. No longer meeting the prescribed standards for active-duty officers.
- Officers cease active duty in one of the following forms:
a. Retirement;
b. Sector transfer;
c. Demobilization;
d. Leaving according to invalid policies.
- When ceasing active duty, if they meet the standards and have not yet reached the age limit for reserve officers as stipulated in Article 38 of this Law, they will transfer to the reserve officer category.
Thus, officers of the Vietnam People's Army cease active duty in the following cases:
- Meeting the conditions for retirement
- Reaching the age limit for active duty
- Due to organizational changes or restructuring, there is no longer a need for professional military officers and defense officials
- No longer meeting the prescribed standards for active-duty officers
In what cases are officers in Vietnam considered for promotion ahead of the scheduled time?
Based on Article 18 of the Law on Officers of the Vietnam People's Army 1999 (amended by Clause 5, Article 1 of the Law on Amendments to the Law on Officers of the Vietnam People's Army 2024), regulations on promotion and salary increase for officers ahead of schedule are as follows:
Article 18. Promotion and salary increase for officers ahead of schedule
- Officers are considered for promotion ahead of schedule stipulated in Clause 2, Article 17 of this Law in the following cases:
a) Achieving outstanding achievements in combat or being commended for work;
b) Successfully completing responsibilities and duties where the current rank is two or more levels lower than the highest rank for the position held or where the current rank is lower than the highest rank for command and management positions.
- Officers are considered for a salary increase ahead of schedule if they achieve outstanding combat achievements or are commended for their work.
- The Government of Vietnam specifically stipulates the criteria and standards in Clause 1 of this Article for considering the promotion of officers to General rank ahead of schedule. The Minister of National Defense specifically stipulates the criteria and standards for considering the promotion of officers to Colonel, Major, and Captain ranks and for a salary increase ahead of schedule as stipulated in Clause 1 and Clause 2 of this Article.
Thus, officers are considered for promotion ahead of the scheduled time in the following cases:
- Achieving outstanding achievements in combat or being commended for work
- Successfully completing responsibilities and duties where the current rank is two or more levels lower than the highest rank for the position held or where the current rank is lower than the highest rank for command and management positions.
