What are the marriage conditions in 2025 in Vietnam?
Pursuant to Article 8 of the Law on Marriage and Family 2014, the conditions for marriage are as follows:
Article 8. Conditions for marriage
- A male and female getting married to each other must comply with the following conditions:
a) The male is from full 20 years old or older, and the female is from full 18 years old or older;
b) Marriage voluntarily decided by the male and female;
c) Not losing civil act capacity;
d) Marriage does not fall into cases prohibited by marriage prescribed in Points a, b, c, and d Clause 2 Article 5 of this Law.
- The State does not recognize marriage between people of the same sex.
According to the above regulations, the conditions for marriage in 2025 are as follows:
[1] The male is from full 20 years old or older, and the female is from full 18 years old or older
[2] Marriage voluntarily decided by the male and female
[3] Not losing civil act capacity
[4] Marriage does not fall into the following prohibited cases:
- Sham marriage, sham divorce
- Child marriage, forced marriage, fraudulent marriage, obstructing marriage
- A person who is currently married marries or lives as husband and wife with another person or is unmarried and marries or lives as husband and wife with someone who is married
- Marriage or living as husband and wife between people of direct blood line; between people with relatives within three generations; between adoptive parents and adopted children; between those who have been adoptive parents and adopted children, parents-in-law and daughters-in-law, mothers-in-law and sons-in-law, stepparents and stepchildren
Note: The State does not recognize marriage between people of the same sex.
Where to register a marriage with a foreigner in Vietnam?
Pursuant to Article 37 of the Law on Civil Status 2014 stipulating the authority to register marriages:
Article 37. Authority to register marriages
- The district-level People's Committee in the place where a Vietnamese citizen resides shall carry out the registration of a marriage between a Vietnamese citizen and a foreigner; between a Vietnamese citizen residing in the country and a Vietnamese citizen residing abroad; between Vietnamese citizens residing abroad; between Vietnamese citizens who concurrently hold foreign citizenship with Vietnamese citizens or with foreigners.
- If a foreigner residing in Vietnam requests marriage registration in Vietnam, the district-level People's Committee in the place where one of the parties resides shall carry out the marriage registration.
According to the above regulations, to marry a foreigner, the marriage must be registered at the district-level People's Committee in the place of residence of the Vietnamese citizen.
