What is duration of veterinary practice certificates in Vietnam? How much is penalty for using an expired veterinary practice certificate in Vietnam?
I have a veterinary practice certificate. Recently, while practicing, my brother was examined and made a record of his act of using an expired veterinary practice certificate. So what is duration of veterinary practice certificates in Vietnam and how much is penalty in this case?

1. What is duration of veterinary practice certificates in Vietnam?
Article 109 of the Law on Veterinary Medicine 2015 stipulates granting and extension of the Veterinary practice certificate, as follows:
1. Competence in granting the Veterinary practice certificate:
a) The veterinary authorities of provinces are responsible for granting the Veterinary practice certificates to entities performing the activities specified in clauses 1, 2 and 3 Article 107 of this Law.
b) Department of Animal Health is responsible for granting the Veterinary practice certificates to entities performing the activities specified in clause 4 Article 107 of this Law.
2. An application for the Veterinary practice certificate shall include:
a) An application form;
b) Qualifications conformable to specific forms of veterinary practice;
c) The Health certificate;
d) The ID card. Regarding foreigners, apart from the regulations in points a, b and c of this clause, the application shall include the judicial records verified by competent agencies.
3. Procedures for granting the Veterinary practice certificate:
a) Any individuals wishing to obtain the Veterinary practice certificate shall submit the application to a veterinary authority according to the regulations in clause 1 of this Article;
b) Within 05 working days from the day on which the satisfactory application is received, the receiving agency shall decide the granting of the Veterinary practice certificate. If the application is rejected, a written response containing the explanation shall be made.
4. A Veterinary practice certificate is effective for 05 years.
5. Procedures for extension of the Veterinary practice certificate:
a) Any individuals wishing to extend the Veterinary practice certificate shall submit the application to a veterinary authority within 30 days before the expired dated of the certificate according to the regulations in clause 1 of this Article. The application shall include an application form for extension, the granted Veterinary practice certificate and the Health certificate;
b) Within 03 working days from the day on which the satisfactory application is received, the receiving agency shall decide the extension of the Veterinary practice certificate. If the application is rejected, a written response containing the explanation shall be made.
According to this Article, your veterinary practice certificate will be valid for 5 years from the date of issuance of veterinary practice certificate in Vietnam.
2. How much is penalty for using an expired veterinary practice certificate in Vietnam?
Pursuant to Article 41 of Decree 90/2017/ND-CP as amended and supplemented by Article 3 of Decree 07/2022/ND-CP providing for violations against procedures for veterinary practice, according to which:
1. A fine ranging from VND 4,000,000 to VND 5,000,000 shall be imposed for erasing or altering the contents of the veterinary practicing certificate.
2. A fine ranging from VND 5,000,000 to VND 6,000,000 shall be imposed for leasing, renting or borrowing the veterinary practicing certificate.
3. A fine ranging from VND 6,000,000 to VND 7,000,000 shall be imposed for failing to have veterinary practicing certificates or using expired ones when practicing in inoculation, treatment, surgery of animals; examination, diagnosis, testing on animals; consultation on activities relating to veterinary medicine.
4. A fine ranging from VND 7,000,000 to VND 8,000,000 shall be imposed for providing false information or forging documents in the application for the veterinary practicing certificate.
5. Additional penalties:
Confiscate documents, papers and veterinary practicing certificate if any of the violations prescribed in Clause 2 and Clause 4 of this Article is committed.
6. Remedial measures:
Enforced return of veterinary practicing certificate if the violation in Clause 1 of this Article is committed.
Thus, when your veterinary practice certificate expires, you may be fined from VND 6,000,000 to VND 7,000,000 in Vietnam.
