Pursuant to Article 19 of Circular 15/2016/TT-BKHCN stipulating adjustment of implementation time of applied research projects funded by the National Science and Technology Development Fund as follows:

1. In case the project cannot be completed on time according to the contract, at least 60 (sixty) days before the end of the contract performance period, the lead organization and the project manager must report In writing, explain the reason and propose the extension of the project implementation and send it to the Fund together with a report on the implementation of the project up to the time of requesting the extension. Within 30 (thirty) days from the date of receipt of the proposal, the Fund shall consider and reply in writing on accepting or not accepting the extension of the project implementation. The maximum extension period is 12 (twelve) months.

2. In case the project has completed the work content, has implemented at least 2/3 (two thirds) of the research time and has enough scientific products according to the contract, the project manager and the host organization. submit a written request and a summary report on the results of the project implementation (Form NCUD06) specified in the Appendix issued with this Circular for the Fund to consider, evaluate, and accept the results of the project implementation.

What are other adjustments of applied research projects funded by the National Science and Technology Development Fund in Vietnam?

According to Article 20 of Circular 15/2016/TT-BKHCN, other adjustments of applied research projects funded by the National Science and Technology Development Fund are as follows:

1. The lead organization or project manager is entitled to make adjustments in the following cases but does not change the objectives, time, research results of the topic and the total funding for the project implementation:

a) Adjusting the procurement of supplies, raw materials, fuel, repair and procurement of fixed assets: For the project implemented by the method of contract spending to the final product, the project manager, the main organization Project maintenance is allowed to proactively decide to adjust the procurement plan and estimate on the quantity, volume and types of supplies, raw materials and materials purchased with the state budget, repair and purchase plans for fixed assets and does not increase the total cost of approved materials;

b) Adjusting and supplementing individuals participating in research: The project leader, the project leader may actively change the individual participating in the research (not the main implementing member, the scientific secretary). ) to ensure good implementation of the project's objectives and products have been approved. The change of individuals participating in the research must have the consent of the supplemented and replaced persons and must satisfy the requirements in Clause 3, Article 8 of this Circular;

c) For outgoing delegations: For projects carried out by the method of lump sum payment to the final product, the lead organization and project leader may actively decide to adjust the group's plan.

For the topic implemented by the method of partial payment, the lead organization and the project leader can actively adjust the time and time of organizing the delegation in accordance with reality.

2. The Fund considers approval and adjustment for the following cases:

a) Adjusting the procurement of supplies, raw materials, fuel, materials, procurement and repair of fixed assets: For the project implemented by the method of partial payment, the organization in charge of the topic, the project leader. The author has a written explanation to the Fund about the adjustment of non-contracted expenditures in the topic. The Fund considers the adjustment of procurement plans and estimates on the quantity, volume and types of supplies, raw materials, fuels, equipment, and machinery purchased with the state budget;

b) Adjustment and addition of individuals participating in research: In case of addition or replacement of main implementing member, scientific secretary, written consent of the Fund is required. Individuals participating in research must meet the requirements in Clause 3, Article 8 of this Circular;

c) Adjustment of outgoing delegations: For projects carried out by partial payment package, in case of adjusting the destination country, the number of participants, the budget for organizing the delegation out, the Fund's written opinion is required.

3. In other cases, the organization in charge and the project manager shall propose to the Fund for consideration and decision.

What are procedures for adjustment of applied research projects funded by the National Science and Technology Development Fund in Vietnam?

According to Article 21 of Circular 15/2016/TT-BKHCN stipulating procedures for adjustment of applied research projects funded by the National Science and Technology Development Fund as follows:

1. For the contents under the management competence of the Fund:

a) Dossier of application for adjustment includes: An application form for change of contract contents by the subject manager enclosed with the official letter of request from the project lead organization (Form NCUD07) specified in the Appendix issued together with this Circular. in accordance with this Circular; other relevant documents (if any);

b) Within 30 (thirty) days from the date of receipt of a complete application for adjustment, the Fund shall issue a decision on adjustment or send a written reply to the project leader clearly stating the reasons therefor. no adjustment;

c) The Fund Management Council shall decide on the adjustment plan for the cases of adjusting the name, objectives, products, total funding, the lead organization, the project leader as prescribed in Articles 14 and 15, Article 16, Article 17 of this Circular. In case of necessity, the Fund Management Board consults with independent experts before making a decision.

With regard to the adjustments decided by the Fund Management Council, the Fund Management Agency shall, based on the adjustment dossier, prepare a plan and submit it to the Fund Management Council for consideration and decision;

d) The Fund's governing body considers and decides on the adjustment of implementation time, implementation content, research members, delegation, procurement plan for procurement of materials and materials of the securities projects. Partial, non-contributory expenditures specified in Article 15, Clause 2, Article 18, Article 19, Clause 2 and Clause 3, Article 20 of this Circular on the basis of ensuring the set product objectives and not changing total cost of the project. In case of necessity, the Fund's executive agency shall seek advice from an independent consultant before making a decision;

dd) Amendments (if any) are part of the signed Contract.

2. The organization in charge of the topic takes the initiative in deciding to adjust the contents specified in Article 15, Clause 1, Article 18 and Clause 1, Article 20 of this Circular:

a) Dossier, order and procedures for adjustment shall comply with the internal regulations of the organization in charge of the topic;

b) In case of not accepting the change of the project manager, within 15 (fifteen) days from the date of receiving the written request for adjustment, the lead organization must give written comments to the project owner. The subject matter clearly states the reasons for not agreeing to the adjustment.
