My veterinary practice certificate expires in over a month. Can I apply for an extension now? If I don't renew it, and will I be fined for keep examining on cats and dogs? How much is the fine for this violation?

Answer:

Pursuant to Clause 5.a Article 109 of the Law on Veterinary Medicine in 2015 stipulating as follows:

Any individuals wishing to extend the Veterinary practice certificate shall submit the application to a veterinary authority within 30 days before the expired dated of the certificate according to the regulations in clause 1 of this Article. The application shall include an application form for extension, the granted Veterinary practice certificate and the Health certificate;

As regulations above, any individuals wishing to extend the Veterinary practice certificate shall submit the application to a veterinary authority within 30 days before the expired dated of the certificate.

According to the information you provided, your veterinarian license expires in over a month. Therefore, you can start the renewal process now.

In the event that your veterinary practice certificate expires and you continue to examine dogs and cats, you will be fined in accordance with Decree 90/2017/NĐ-CP.

Pursuant to Clause 3 Article 41 of the Decree 90/2017/NĐ-CP stipulating as follows:

A fine ranging from VND 6,000,000 to VND 7,000,000 shall be imposed for failing to have veterinary practicing certificates or using expired ones when practicing in inoculation, treatment, surgery of animals; examination, diagnosis, testing on animals; consultation on activities relating to veterinary medicine.

The above penalty applies to individuals who violate the regulations (Clause 2, Article 4 of Decree 90/2017/NĐ-CP).

Pursuant to Clause 1.d Article 105 of the Law on Veterinary Medicine in 2015, labels of veterinary drugs against the regulations in Article 103 of this law shall be recalled.

Pursuant to Clause 3.d Article 105 of the Law on Veterinary Medicine in 2015, one of handling measures for the recalled veterinary drugs is correction of mistake on labels.

In addition, Clause 1.c Article 40 of the Circular 13/2016/TT-BNNPTNT also provides more detailed regulations on the handling of recalled veterinary drugs in the event that the labeling of veterinary drugs is not in accordance with regulations, specifically:

Recall and correct labeling errors for veterinary drugs with labels that do not comply with the provisions of the law on product labeling.

Therefore, based on the above regulations, veterinary drugs that do not meet the labeling requirements for veterinary drugs will be recalled and the labeling errors will be corrected.

In addition, there are no regulations that require the destruction of drugs when the labeling of veterinary drugs is not in accordance with regulations. Therefore, if the labeling of veterinary drugs is not in accordance with regulations, it is only required to correct the labeling errors.

Is it compulsory to include the text “ For use in veterinary medicine only” in the labels of veterinary drugs in Vietnam?

Pursuant to Clause 3 Article 103 of the Law on Veterinary Medicine in 2015, the label shall contain the text “ For use in veterinary medicine only”.

In general, the labels of veterinary drugs in Vietnam shall include the text “ For use in veterinary medicine only”.

However, Article 23 of the Circular 13/2016/TT-BNNPTNT also stipulates the types of veterinary drugs that must be labeled as follows:

1. Drugs in circulation in Vietnam; exported and imported drugs must be labeled in accordance with the regulations of this Circular, except for the cases specified in Clause 2 of this Article.

2. In case foreign organizations or individuals importing Vietnamese drugs request to label them according to the sales contract and are responsible for their requirements, the organizations or individuals exporting drugs may implement them according to the contract, provided that these requirements do not misrepresent the nature of the drug, do not violate Vietnamese law and the law of the importing country.

According to this regulation, in the case that foreign organizations or individuals importing Vietnamese drugs request to label them according to the sales contract and are responsible for their requirements, the organizations or individuals exporting drugs shall implement them according to the agreed contract. In this case, the labeling of veterinary drugs is not mandatory.

Therefore, if foreign organizations or individuals importing Vietnamese drugs do not require the veterinary drug label to have the phrase "For use in veterinary medicine only", the exporting party does not have to put this phrase on the drug label.
