Procedure for Re-determination of Ethnicity in Birth Certificate
Procedure for Re-determination of Ethnicity in Birth Certificate is carried out as follows:
1. Legal Basis:
Civil Status Law 2014
Civil Code 2015
Circular 85/2019/TT-BTC
Circular 04/2020/TT-BTP
2. Conditions:
- Re-determined according to the ethnicity of the biological father or biological mother in cases where the biological father and mother belong to two different ethnic groups;
- Re-determined according to the ethnicity of the biological father or biological mother in cases where an adopted child has identified their biological father or mother.
Note: The re-determination of ethnicity for individuals aged between 15 (fifteen) and under eighteen years old must be agreed upon by the individual concerned.
3. Dossier:
The applicant must submit:
- Application form (as per the attached template in Circular 04/2020/TT-BTP)
- One original birth certificate.
- One copy of the household registration book.
- One copy of the identity card. (if available)
- Relevant documents proving the request for ethnicity re-determination.
4. Submission Method: Submit the dossier directly.
5. Handling Agency: District-level People's Committee.
6. Processing Time Limit: 03 working days from the date of receipt of complete and valid documents. In case verification is needed, it can be extended but not more than 03 working days.
7. Fee: Determined by the Provincial People's Council, depending on the specific conditions and situation of the locality.
