Procedure for Household Registration in Centrally-Administered Cities

Regarding the permanent residence registration. I would like to ask the editorial board about the procedures for permanent residence registration in centrally governed cities. I am eagerly looking forward to the advice on this matter.

1. Legal Basis:

Resolution 07/2017/NQ-HDND;

Circular 85/2019/TT-BTC;

Residence Law 2020;

Resolution 06/2020/NQ-HDND;

Resolution 13/2021/NQ-HDND.

2. Conditions:

  1. Citizens are allowed to register for permanent residence at a legal residence not owned by them when the household head and the legal residence owner agree in the following cases:

- Wife moving in with husband; husband moving in with wife; child moving in with father or mother; father, mother moving in with child;

- Elderly people moving in with biological brothers, sisters, nieces, nephews; severely disabled people, heavily disabled people, people who are unable to work, people with mental illnesses or other illnesses that affect cognition and behavior control moving in with grandfathers, grandmothers, uncles, aunts, or guardians;

- Minors moving in with grandparents, biological brothers, sisters, aunts, uncles with the consent of their parents or guardians if the parents are deceased.

  1. Except for the cases mentioned above, citizens are allowed to register for permanent residence at a legal residence by renting, borrowing, or staying with someone when they meet the following conditions:

- Obtaining the consent of the legal residence owner to register for permanent residence at the rented, borrowed, or stay-over location and obtaining the consent of the household head if registering for permanent residence into that household;

- Ensuring the minimum housing area condition prescribed by the Provincial People's Council, but not less than 8 m2 of floor area/person.

Note: In the case of legal residence by renting, borrowing, or staying over of an individual, it must be agreed in writing by the person who rents, lends, or allows the stay-over. The minimum housing area condition prescribed by the Provincial People's Council must still be met, but not less than 8 m2 of floor area/person.

3. Dossier:

- Household declaration form;

- Notification of residence, household registration change form;

- Household registration transfer document as regulated;

- Documents and materials proving legal residence.

- Other documents as regulated:

For citizens owning houses in Ho Chi Minh City, Hanoi:

- Residence information change declaration form;

- Documents and materials proving the ownership of legal residence.

In the case of moving in with relatives

- Residence information change declaration form, specifying the consent for permanent residence registration given by the household head, legal residence owner, or the authorized person, unless there is already written consent;

- Documents and materials proving the kinship with the household head, household members, unless this kinship information is already present in the National Population Database, Residence Database;

- Documents and materials proving conditions of disability, mental illness, etc. (if applicable).

In the case of legal residence by renting, borrowing, staying over

- Residence information change declaration form, specifying the consent for permanent residence registration given by the household head, legal residence owner, or the authorized person, unless there is already written consent;

- Rental agreement, borrowing, stay-over document of the legal residence certified or notarized according to the law;

- Documents and materials proving sufficient housing area to register for permanent residence as regulated.

4. Submission Method: Direct submission.

5. Processing Agency: District-level police.

6. Processing Time:

Within 7 working days from the date of receiving a complete and valid dossier, the residence registration agency shall review, update the information of the new permanent residence of the registrant into the Residence Database and notify the registrant about the updated registration; if the registration is denied, a written response stating the reasons must be provided.

7. Fees:

- The residence registration fee in Ho Chi Minh City is currently regulated by Resolution 07/2017/NQ-HDND:

+ 10,000 at District and 5,000 at Sub-District (if already having a household registration book)

+ 25,000 at District and 13,000 at Sub-District (if not having a household registration book yet)

- The residence registration fee in Hanoi is currently regulated by Resolution 06/2020/NQ-HDND, as amended by Resolution 13/2021/NQ-HDND:

+ 10,000 at District and 5,000 at Sub-District (if already having a household registration book)

+ 25,000 at District and 13,000 at Sub-District (if not having a household registration book yet).
