Procedure for Correction and Supplementation of Civil Status for Vietnamese Citizens Residing Domestically
1. Legal Basis:
- Civil Status Law 2014;
- Circular 85/2019/TT-BTC;
- Circular 04/2020/TT-BTP.
2. Conditions:
- Correction of civil status
+ Correction of civil status is only resolved after identifying errors during civil status registration; it is not used to correct information on the legally issued civil status documents to legitimize information on other personal records and documents.
+ Errors in civil status registration are errors made by the person registering the civil status or errors made by the civil status registration authority.
- Supplementation of civil status
+ Civil status documents specified in Clause 2, Article 75 of the Civil Status Law are valid for use without needing to add missing civil status information compared to the current civil status forms;
+ Civil status documents legally issued from January 01, 2016, with missing civil status information, can be supplemented if there are valid documents and materials issued by competent authorities to prove it.
- When there are grounds for changing the information about the father or mother in the registered birth content after being adopted according to the provisions of the Adoption Law.
3. Dossier:
- Declaration form for registration of change, correction, supplementation of civil status, or ethnic re-identification as per the template.
- Documents serving as a basis for the change, correction, or supplementation of civil status.
- Power of attorney document according to legal provisions in case of authorization to perform the registration of change, correction, or supplementation of civil status. If the authorized person is the grandparent, parent, child, spouse, brother, or sister of the authorizing person, the power of attorney document does not need to be notarized or authenticated, but must have documents proving the relationship with the authorizing person.
4. Submission Method: Directly submit the dossier or send the dossier through the postal system.
5. Resolving Authority:
- The People's Committee of the commune where the civil status change or correction for persons under 14 years old was registered.
- The People's Committee of the district where the civil status change or correction for persons aged 14 years and above was registered.
6. Time Limit for Resolution:
- 03 working days for requests for change or correction of civil status; in cases requiring verification, the time limit for resolution is not more than 06 working days.
- On the same working day for requests for the supplementation of civil status, if the dossier is received after 3 PM and cannot be resolved immediately, the result is returned on the next working day.
7. Fees: Determined by the Provincial People's Council, depending on the specific conditions and situation of the locality.
