Procedure for Correction and Supplementation of Civil Status for Vietnamese Citizens Residing Abroad
1. Legal Basis:
- Civil Status Law 2014;
- Circular 85/2019/TT-BTC;
- Circular 04/2020/TT-BTP.
2. Conditions:
- Civil Status Correction
+ The civil status correction shall only be resolved after determining that there are mistakes during civil status registration; it is not to correct the content on legally issued civil status documents to legalize information on other personal records and documents.
+ Mistakes in civil status registration can be mistakes made by the person registering the civil status or mistakes made by the civil status registration agency.
- Civil Status Supplement
+ Civil status documents specified in Clause 2, Article 75 of the Civil Status Law are valid for use without needing to add missing civil status information compared to the current civil status forms;
+ Civil status documents legally issued from January 01, 2016, with missing civil status information shall be supplemented if there are legitimate documents or materials issued by competent authorities or organizations proving such information.
- When there is a basis for changing information about the father or mother in the registered birth content after being adopted according to the Adoption Law.
3. Dossier:
- Application form for registration of change, correction, supplement, and re-determination of ethnicity according to the template.
- Documents serving as the basis for the change, correction, or supplement of civil status records.
- Written authorization according to legal regulations in case of authorization for performing the registration of change, correction, or supplement of civil status records. If the authorized person is the grandparent, parent, child, spouse, sibling of the authorizing person, the written authorization does not need certification.
4. Submission Method: Submit the dossier directly.
5. Resolving Agency: The District People's Committee of the place of residence before departure performs the change, correction, supplement of civil status information, and re-determination of ethnicity.
6. Processing Timeframe:
- Within 03 working days from the date of receiving all required documents, if it is found that the change or correction of civil status is justified and in accordance with civil and related laws, the civil status official shall record this in the Civil Status Register, together with the applicant, sign the Civil Status Register, and report to the Chairman of the Commune People's Committee to issue an extract to the applicant.
- In cases where verification is needed, the timeframe is extended by no more than 03 additional working days.
7. Fees: Determined by the Provincial People's Council, depending on the specific conditions and situation of the locality.
