Procedure for Correction and Supplementation of Civil Status for Foreigners Registered in Vietnam
1. Legal Basis:
- Civil Status Law 2014;
- Circular 85/2019/TT-BTC;
- Circular 04/2020/TT-BTP.
2. Conditions:
- Correction of Civil Status
+ Civil status correction is only resolved after determining that there was an error during the civil status registration; there is no correction of content on legally issued civil status documents to formalize information on other personal records and documents.
+ Errors in civil status registration are errors made by the person registering the civil status or errors of the civil status registration agency.
- Supplementation of Civil Status
+ Civil status documents stipulated in Clause 2, Article 75 of the Civil Status Law are valid for use without adding missing civil status information following the current civil status form;
+ Civil status documents legally issued since January 1, 2016, which have missing civil status information, will be supplemented if there are valid documents and materials issued by a competent authority as proof.
- When there are grounds to change information about the father or mother within registered birth contents after being adopted as per the Adoption Law.
3. Dossier:
- Declaration form for registration of change, correction, supplementation of civil status, re-identification of ethnicity according to the template.
- Documents serving as a basis for changing, correcting, supplementing civil status.
- Authorization document as per legal regulations in case of authorizing registration to change, correct, or supplement civil status. If the authorized person is the grandfather, grandmother, father, mother, child, spouse, brother, or sister of the authorizer, the authorization document does not need notarization or certification but must have documents proving the relationship with the authorizer.
4. Submission Method: Direct submission of dossier.
5. Resolving Agency:
- In case the requester is a foreigner residing in Vietnam, the district-level People's Committee where the person resides will correct and supplement the civil status information.
- In case the requester is a foreigner not residing in Vietnam, the district-level People's Committee where the Department of Justice is headquartered, which previously registered the civil status, will correct and supplement the civil status information.
After performing the change, correction, supplementation of civil status, or re-identification of ethnicity, the district-level People's Committee shall send a notification with a copy of the civil status extract to the Department of Justice for notation in the Civil Status Register as regulated.
6. Processing Time:
- Within 3 working days from the date of receiving all regulated documents, if the change or correction of civil status is grounded and in conformity with civil and related laws, the judicial-civil status official shall record it in the Civil Status Register, co-sign with the requester for change or correction in the Civil Status Register, and report to the chairman of the commune-level People's Committee to issue an extract to the requester.
- In cases that require verification, the period is extended no more than 3 working days.
7. Fee: Decided by the provincial People's Council, depending on specific local conditions and circumstances.
