Procedure for Changing the Name of a Foreign Citizen Who has Registered Civil Status in Vietnam
1. Legal Basis:
Civil Status Law 2014;
Civil Code 2015;
Circular 85/2019/TT-BTC;
Circular 04/2020/TT-BTP.
2. Conditions:
- When there is a basis for changing the surname, middle name, and first name of an individual in the birth registration content that was registered, there is a basis under civil law regulations.
- Other cases as prescribed by civil status law.
Note: The change of surname, middle name, and first name for a person under 18 years old according to Clause 1 Article 26 of the Civil Status Law must have the consent of both parents and be clearly shown in the declaration; for individuals from 9 years old and above, their consent is also required.
3. Dossier:
- Declaration form (according to the template).
- Original birth certificate of the person changing the name.
- Related documents as a basis for the change.
4. Submission Method:
Submit directly.
5. Responsible Agency:
The District-level People's Committee where the foreign citizen initially registered civil status.
6. Processing Time:
Within 03 working days from the date of receiving the complete documents as prescribed. In case verification is needed, the period can be extended by no more than 03 working days.
7. Fees:
Determined by the Provincial People's Council, depending on the specific conditions and situations of each locality.
