Only the Prime Minister of the Government of Vietnam has the authority to decide on negotiating international treaties?
Based on Article 10 of the 2016 Law on International Treaties, the authority to decide on negotiating international treaties is prescribed as follows:
The President shall decide on negotiating, authorizing negotiation, negotiating policies, and concluding negotiations of international treaties on behalf of the State.
The Prime Minister of the Government of Vietnam shall decide on negotiating, authorizing negotiation, negotiating policies, and concluding negotiations of international treaties on behalf of the Government of Vietnam.
Thus, not only does the Prime Minister of the Government of Vietnam decide on negotiations, but depending on the role and field of negotiation, there are specific regulations on authority. For example, the President has the authority to decide on negotiating, authorizing negotiation, negotiating policies, and concluding negotiations of international treaties on behalf of the State, whereas the Prime Minister of the Government of Vietnam does so on behalf of the Government of Vietnam.
