Is it permitted to import fertilizers that have not been recognized in Vietnam for use?
According to Clause 2, Article 9 of the 2018 Crop Production Law, the regulations on prohibited acts in crop production activities are as follows:
Production, sale, and importation of fertilizers that have not been recognized for circulation in Vietnam, except for the import of fertilizers specified in Clause 2, Article 44 of this Law and the production of fertilizers for export under contracts with foreign organizations and individuals.
Citing Clause 2, Article 44 of this Law, which stipulates that organizations and individuals importing fertilizers that have not been recognized for circulation in Vietnam must obtain a Fertilizer Import Permit in the following cases:
- Fertilizers for testing;
- Fertilizers used for sports fields, recreational areas;
- Fertilizers used in foreign projects in Vietnam;
- Fertilizers as gifts or samples;
- Fertilizers participating in fairs and exhibitions;
- Fertilizers serving scientific research;
- Fertilizers as raw materials for producing other fertilizers;
- Fertilizers for temporary import, re-export, or fertilizers in transit or transshipment through Vietnamese ports; fertilizers stored in bonded warehouses; fertilizers imported into export processing zones.
Thus, if you want to import fertilizers that have not been recognized for circulation in Vietnam, you must fall under the cases mentioned above or produce fertilizers for export under contracts with foreign organizations and individuals according to current regulations.
