Does the wife have any rights over the money that the husband finds?
Based on Clause 1, Article 33 of the Law on Marriage and Family 2014, the common assets of husband and wife are regulated as follows:
The common assets of husband and wife include assets created by either spouse, income from labor, production and business activities, proceeds and profits arising from separate assets, and other lawful income during the marriage period, except in cases stipulated in Clause 1, Article 40 of this Law; assets jointly inherited or jointly given and other assets that the husband and wife agree to be common property.
Referring to Clause 2, Article 9 of Decree 126/2014/ND-CP, lawful income during the marriage period is:
Assets which either spouse establishes ownership according to the provisions of the Civil Code for ownerless property, buried or sunken property, lost or forgotten property, stray livestock or poultry, and aquatic animals.
Thus, as a principle, if there is no other agreement, the money your husband found is common property of both husband and wife, and once it becomes common property, the disposal rights belong equally to both of you.
Respectfully!
