Does 200 cm3 of livestock wastewater have to be treated before discharging such wastewater into the environment in Vietnam? Are there penalties for discharging 200 cm3 of livestock wastewater into the environment in Vietnam?
We raise 150 ducks daily with 200 cm3 of wastewater from this farming. May I ask when we discharge this water into the environment, do we need to treat it? If not, will I be fined? Thank you!

Pursuant to Clause 3, Article 59 of the 2018 Law on Livestock, regulations on treatment of waste from livestock farms are prescribed as follows:
3. Livestock wastewater shall be treated as follows:
a) Owners of livestock farms shall take responsibility to collect and treat livestock wastewater meeting national technical regulations on livestock wastewater before discharging such wastewater into the waste receiving place under law provisions on environmental protection;
b) Livestock wastewater undergoing treatment meeting national technical regulations on livestock waste may be used for plants;
c) Livestock wastewater not undergoing treatment must be moved out the livestock farm to the waste treatment facility by dedicated equipment and vehicles.
As such, you are responsible for collecting and treating livestock wastewater to meet nnational technical regulations on livestock wastewater before discharging such wastewater into the environment in Vietnam.
Are there penalties for discharging 200 cm3 of livestock wastewater into the environment in Vietnam?
Pursuant to Clause 2, Article 30 of Decree 14/2021/ND-CP on offences against regulations on animal farming waste treatment as follows:
2. Offences against regulations on treatment of wastewater from animal farming shall be subject to the following penalties if such treatment fails to conform to the national technical regulations on wastewater from animal farming used for crops:
a) Imposing the fine ranging from 3,000,000 dong to 5,000,000 dong if such offences arise from small-scale animal farming activities;
b) Imposing the fine ranging from 5,000,000 dong to 7,000,000 dong if such offences arise from medium-scale animal farming activities;
c) Imposing the fine ranging from 7,000,000 dong to 10.000.000 dong if such offences arise from large-scale animal farming activities.
Pursuant to Clause 2, Article 5 of Decree 14/2021/ND-CP, as follows:
2. The amount of fine stipulated in Chapter II shall be deemed as the amount of fine for the administrative offence committed by an individual. If an organization commits the same offence, the amount of imposed on that organization shall be 02 times greater than that imposed on an individual.
Pursuant to Clause 2, Article 21 of Decree 13/2020/ND-CP stipulating livestock production scale is prescribed as follows:
2. The livestock production scale is determined as follows:
a) Livestock units ≥ 300: Large-scale farming;
b) 30 ≤ livestock units < 300: Medium-scale farming;
c) 10 ≤ livestock units < 30: Small-scale farming;
d) Livestock units < 10: Family farming.
According to this Article, you raise 150 ducks in medium-scale farming, so you may be fined from VND 5,000,000 to VND 7,000,000 for the act of discharging 200 cm3 of livestock wastewater into the environment without treatment according to the regulations on National technical regulation on livestock wastewater in Vietnam.
