Do Overseas Vietnamese Have to Declare Temporary Residence When Returning to Vietnam?
According to Article 22 of the Law on Residence 2006, it is stipulated that when you emigrate to a foreign country, your permanent residence registration will be annulled.
On the other hand, in Article 2 of the Law on Residence 2006, it is stipulated that Vietnamese citizens residing abroad who retain Vietnamese nationality and return to live in Vietnam are subject to the application of the Law on Residence 2006.
Based on Article 9 of the Law on Residence 2006, the citizens’ rights regarding residence are as follows:
- Choose and decide their place of permanent residence and temporary residence in accordance with the provisions of this Law and other relevant laws.
- Be issued, reissued, and replaced household registration books, temporary residence books, and other documents related to residence.
- Be provided with information and documents related to the exercise of their right to reside.
- Request competent state agencies to take measures to protect their right of residence.
- Lodge complaints, denunciations, and initiate lawsuits against acts violating residence laws in accordance with the law.
Thus, when you return to live in Vietnam, you have the right to decide your place of temporary and permanent residence as prescribed. However, when registering for permanent and temporary residence, you must meet the conditions set by law.
If you register for temporary residence, after the period of temporary residence expires, you must apply for an extension.
