Conditions for the Trading of Fertilizers from January 1, 2020
On November 19, 2018, the National Assembly of the Socialist Republic of Vietnam, 14th legislature, at its 6th session passed the Crop Production Law No. 31/2018/QH14 (referred to as the Crop Production Law 2018).
The Crop Production Law 2018 regulates crop production activities; the rights and obligations of organizations and individuals involved in crop production; and state management of crop production.
According to the provisions of Clause 2, Article 42 of the Crop Production Law 2018 (effective from January 1, 2020), the conditions for fertilizer trading are specifically regulated as follows:
Organizations and individuals trading fertilizers must have a Certificate of Eligibility for Fertilizer Trading; in cases of trading fertilizers they produce themselves, they do not need to have a Certificate of Eligibility for Fertilizer Trading.
Conditions for obtaining a Certificate of Eligibility for Fertilizer Trading include:
- Having a legitimate and clear transaction location;
- Having complete documentation and records for tracing the origin of fertilizers as prescribed;
- Individuals directly engaged in trading fertilizers must be trained and have professional knowledge about fertilizers according to the guidance of the Ministry of Agriculture and Rural Development, except in cases where they already hold a qualification from intermediate level or higher in one of the fields of crop production, plant protection, soil chemistry, soil science, agronomy, chemistry, or biology.
