Conditions for Issuance of Certificate of Eligibility for Fertilizer Production from January 1, 2020
On November 19, 2018, the National Assembly of the Socialist Republic of Vietnam, during its 14th tenure at the 6th session, passed the Cultivation Law No. 31/2018/QH14 (referred to as the Cultivation Law 2018).
The Cultivation Law 2018 regulates cultivation activities; the rights and obligations of organizations and individuals engaged in cultivation activities; and state management of cultivation.
According to Clause 2, Article 41 of the Cultivation Law 2018 (effective from January 1, 2020), the conditions for granting the Certificate of Eligibility for Fertilizer Production include:
- Having a production site and a factory area suitable for the scale of production;
- Having production lines, machinery, and equipment appropriate to the production processes of each type and form of fertilizer;
- Having a testing laboratory or a contract with a designated testing organization to evaluate the quality criteria of the fertilizers produced;
- Having a quality management system that is appropriate and updated with the standards issued by an international standards organization regarding quality management;
- Having separate areas for raw materials and finished products;
- The person directly managing production must have a university degree or higher in one of the fields of cultivation, plant protection, agro-pedology, soil science, agronomy, chemistry, or biology.
