Hello, my family adopted a child. Later, we had another child, but this child was mischievous and was sent to a reformatory to be re-educated. Now the adopted child wants to meet his younger brother personally at reformatory. I don't know if it is possible? If so, how many hours can they meet? Please advise.

According to Article 4 of Circular 43/2015/TT-BCA (Expires: December 12, 2022) stipulates who is allowed to visit students as follows:
1. Persons allowed to visit students
Organizations and individuals allowed to visit students include:
a) Grandparents, paternal and maternal grandparents; Birth parents; stepfather, stepmother; legal adoptive parents; father, mother-in-law (or husband); wife or husband; biological children, daughters-in-law, sons-in-law, and legally adopted children; siblings; brothers and sisters of the wife (or husband); aunts, uncles, nieces, nephews;
b) Representatives of other agencies, organizations or individuals request to visit students, then the Principal of the reformatory or the Director of the compulsory education facility shall consider and resolve the matter if deemed appropriate to the needs, legitimate interests of students and requirements of management and education of students.
2. Responsibilities of visitors to meet students
a) People who visit students must comply with the provisions of law, the Rules of reformatories and compulsory education establishments, and the Rules of Visiting Houses; Follow the instructions of officials of reformatories and compulsory education establishments;
b) Visitors to students are not allowed to bring weapons, toxic substances, explosives, flammable substances, radioactive substances, machinery, information and communication equipment, laptops, computers, cameras, video cameras, and audio recorders in places to visit students. In case a visitor meets a student or camper with the above items, he or she must carry out procedures to send them to the officer in charge of the visit to meet with the manager and receive them back after the visit is completed.
Thus, the relatives specified above can visit the student in the reformatory in Vietnam (not including the foster brother). However, the foster brother can request to visit the child in the reformatory. This will be decided by the Principal before deciding whether it is appropriate or not.
How many hours can foster brother visit his younger brother in the reformatory in Vietnam?
According to Article 3, Circular 43/2015/TT-BCA (Expires: December 12, 2022) regulates standards, conditions, time and location for visiting students as follows:
1. Visit students
a) Students are allowed to meet relatives at the reformatory's Visiting House (except in cases of violating the reformatory school's rules and being isolated from other students);
b) Students are allowed to see relatives no more than 3 hours at a time. In case a student well complies with the reformatory school's regulations, actively studies, works, trains or exercises rights and obligations according to the law, the principal of the reformatory shall decide to extend the time. Visit but not more than 48 hours/time.
2. Visit campers
a) Campers are allowed to meet their relatives at the Visiting House of the compulsory education facility twice a month (except in cases of violating the Rules of the compulsory education facility and are being isolated from other campers). If you receive a reward, you will be able to meet one more time;
b) Campers are allowed to see relatives no more than 02 hours/time. If the campers comply well with the regulations of the compulsory educational institution, actively study, work or exercise their rights and obligations according to the provisions of law, the Director of the compulsory educational institution shall decide to extend the visit time but not to exceed 48 hours/time;
c) Campers who make great efforts in working, studying, strictly complying with the regulations of the compulsory education institution or having achieved meritorious service, the Director of the compulsory education institution may allow them to see their spouse for up to 48 hours/times and stay overnight in a private room of the Visiting House.
3. Students can meet their relatives from 7:00 a.m. to 11:00 a.m., from 1:00 p.m. to 4:30 p.m. in the afternoon on all days of the week, holidays, holidays, and Tet. In cases where relatives of students or detainees do not know the time of visit or live too far away to visit at the wrong time or in other special cases, the principal of the reformatory or the director of the compulsory education facility must consider for decision.
4. When visiting, you must use Vietnamese. In case you are an ethnic minority or a foreigner who does not know Vietnamese, you must be supervised by an interpreter or have an officer who knows the ethnic language or the language of that country.
5. When visiting students, campers must be clean, have neat hair, wear long clothes and shoes or sandals. Campers must wear provided long clothes. If they have just arrived to comply with the decision and have not yet been given clothes, they can borrow clothes or wear regular long clothes (if any).
According to this Article, in case the foster brother is considered for permission to meet the child who is a student in a reform school in Vietnam, the visit time is no more than 3 hours/time. In case the student obeys the rules well, actively studies and practices, the visit time can be considered to be extended but not to exceed 48 hours/time.
Is there a fee to visit a student in a reformatory in Vietnam?
Article 6 of Circular 43/2015/TT-BCA (Expires: December 12, 2022) regulates Visiting House to students as follows:
1. Each reformatory or each reformatory school branch (if there is a branch) must have a House to visit students; Each compulsory education facility or each subdivision of a compulsory education facility (if there is a subdivision) must have a Visiting House built according to the design of the Ministry of Public Security, located in a place convenient for meeting, managing visits. The visiting house must be equipped with necessary tools and equipment to serve the visits and activities of relatives of students.
2. The visiting house must post signs "Visiting house to meet students", "House visiting to meet campers", and have a suggestion box for relatives, students, and campers to reflect and contribute ideas.
3. Do not collect fees for relatives visiting students or campers or allowing extra time for students or campers to meet.
According to this Article, when visiting students in reform schools, no visiting fee will be collected in Vietnam.
